Terms of Service

Welcome to Candu! These Terms of Service ("Terms") govern your access to and use of the Candu platform and services. Please read them carefully.
1. Acceptance of Terms
By creating an account, accessing, or using Candu ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and Candu. You represent that you are at least 18 years old and have the legal capacity to enter into this agreement.
2. Description of Service
Candu is an educational lesson planning platform designed specifically for teachers in Canada. The Service provides tools and resources to help educators create, manage, and deliver curriculum-aligned lesson plans.
Our Service includes:
- AI-powered lesson plan generation
- Curriculum-aligned content for Canadian provinces
- Calendar and schedule management
- Teaching resources and activity suggestions
- Student engagement tools
- Professional development resources
3. Account Registration
To use Candu, you must create an account by providing accurate and complete information, including:
- Full name
- Valid email address
- Secure password
- Teaching information (province, grade level, subjects)
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
4. Subscription Plans and Pricing
4.1 Available Plans
Candu offers the following subscription tiers:
- Free Plan: Basic access with limited features at no cost
- Permanent Teacher Plan ($29.99 CAD/month): Full access to all features, including advanced lesson planning, unlimited content generation, and premium resources
- Substitute/EA Plan ($19.99 CAD/month): Specialized access designed for substitute teachers and educational assistants
4.2 Free Trial
New subscribers to paid plans receive a 30-day free trial. During the trial period:
- You have full access to all features of your selected plan
- No charges will be made during the trial period
- You may cancel at any time before the trial ends with no charge
- After 30 days, you will be automatically charged unless you cancel
4.3 Billing and Payment
By subscribing to a paid plan, you authorize Candu to charge your payment method:
- Subscriptions are billed monthly in advance
- All prices are in Canadian Dollars (CAD)
- Payment is processed securely through Stripe
- You will receive a receipt via email for each payment
- Subscriptions automatically renew unless cancelled
4.4 Price Changes
We reserve the right to change our pricing at any time. You will be notified of any price changes at least 30 days in advance. Continued use of the Service after the price change constitutes acceptance of the new price.
5. Cancellation and Refund Policy
5.1 Cancellation
You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:
- You will retain access to paid features until the end of your current billing period
- No further charges will be made
- Your account will be automatically downgraded to the Free plan
- Your data and created content will be preserved
5.2 Refund Policy
We do not provide refunds for partial subscription periods. If you cancel mid-cycle, you will have access until the end of your billing period, but no prorated refund will be issued.
Exception: If you cancel within the first 7 days of your first paid subscription (after the trial period), you may request a full refund by contacting support@can-du.com.
6. User Responsibilities and Conduct
6.1 Acceptable Use
You agree to use Candu only for lawful educational purposes. You will NOT:
- Share your account credentials with others
- Use the Service for any commercial purpose without authorization
- Reproduce, redistribute, or sell any content from the platform
- Attempt to circumvent any security measures
- Upload malicious code or attempt to disrupt the Service
- Scrape or automatically extract data from the platform
- Use the Service in any way that violates applicable laws
6.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities conducted through your account
- Notifying us immediately of any unauthorized access
7. Intellectual Property Rights
7.1 Candu's Rights
All content provided by Candu, including but not limited to lesson plans, teaching materials, resources, software, designs, text, graphics, and trademarks, are owned by Candu or its licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Your License to Use Content
Subject to these Terms, Candu grants you a limited, non-exclusive, non-transferable license to:
- Access and use the Service for your personal teaching purposes
- Download and print lesson plans and materials for classroom use
- Modify generated content to fit your specific teaching needs
7.3 Restrictions
You may NOT:
- Sell, redistribute, or sublicense any Candu content
- Post Candu materials on public websites or platforms
- Remove copyright notices or branding from materials
- Create derivative works for commercial purposes
7.4 User-Generated Content
You retain ownership of any content you create using Candu. By using the Service, you grant Candu a worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the Service.
8. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

- We use industry-standard security measures to protect your data
- You have rights to access, correct, and delete your data
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
Candu disclaims all warranties, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- That the Service will be uninterrupted or error-free
- That all content will be accurate or complete
- That the Service will meet your specific requirements
You use the Service at your own risk. We recommend reviewing all generated content before using it in your classroom.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANDU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This includes but is not limited to:
- Loss of profits or revenue
- Loss of data or content
- Loss of business opportunity
- Cost of substitute services
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to Candu in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Candu, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or share through the Service
12. Termination
12.1 By You
You may terminate your account at any time by cancelling your subscription or contacting support.
12.2 By Candu
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- Your payment method fails and is not updated
- We suspect fraudulent or illegal activity
- We discontinue the Service (with 30 days notice)
12.3 Effect of Termination
Upon termination:
- Your right to access the Service immediately ceases
- We may delete your account data after 90 days
- You remain liable for any outstanding payments
- Provisions that should survive termination will remain in effect
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes:
- We will notify you via email at least 30 days in advance
- We will post the updated Terms on our website
- The "Effective Date" at the top will be updated
Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you must cancel your subscription.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of the Province of New Brunswick, Canada, without regard to conflict of law principles.
14.2 Informal Resolution
Before filing any legal claim, you agree to contact us at support@can-du.com to attempt to resolve the dispute informally.
14.3 Jurisdiction
Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts located in New Brunswick, Canada.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Candu regarding the Service.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
